1. Booking and Payment Policies
Reservation Confirmation: By submitting a booking request through our website, you are making an offer to rent accommodation which is subject to our acceptance. A booking is only confirmed once you receive a written confirmation email and have paid the required deposit.
Payment Schedule: A 30% non-refundable deposit is required to secure your booking of the entire house. The remaining balance is due 7 days before your arrival date. For bookings made less than 7 days before arrival, full payment is required once the booking is confirmed and accepted.
2. Cancellation and Refund Policies
Cancellation Terms: Cancellations must be made in writing via email to; contact@hagonrestaurants.com/0786510210
Cancellations made 30+ days before arrival: Full refund
Cancellations made 14 days before arrival: 50% refund minus deposit
Cancellations made less than 7 days before arrival: No refund
Refund Processing: Any refund will be communicated upon contact, if applicable.
3. Check-In and Check-Out Procedures
Timings: Check-in time is from 11:00 AM to 8:00 PM. Check-out time is by 3:00 PM. This can be adjusted upon request but is not guaranteed.
Late Arrivals or Departures: Late check-out may result in additional charges.
4. Occupancy and Use of Property
Maximum Occupancy: If the guests exceed more than 15 guests then the host should be informed beforehand.
Purpose of Stay: The Getaway is mainly for recreational purposes but if there arises an alternative purpose i.e. events the host should be informed prior and this is subject to additional charges from the host once consent is given.
5. Guest Responsibilities
Property Care: All guests should ensure that the property is left as found and if any damage occurs, they will be charged accordingly upon checkout.
Behavioral Guidelines: Guests should respect the community around and maintain the noise levels.
6. Liability and Disclaimers
Owner's Liability: The owner shall not be held liable for any accidents, injuries, illnesses, loss, theft, or damage to personal property that may occur during your stay.
Guest's Liability: By confirming a booking, guests accept full responsibility for their actions and those of any individuals in their party, including children and pets. Guests are encouraged to exercise due care and caution throughout their stay.
7. Pet Policy
All pets are allowed as long as they have been well-vaccinated and trained to accommodate humans due to the employees on the property.
8. Smoking Policy
Smoking is only limited to the gazebo.
9. Termination of Agreement
Breach of Terms: Any breach of these terms and conditions may result in:
- Immediate eviction from the property
- Charges for any damages incurred
- Possible legal action at the discretion of the host
The right to enforce these consequences is reserved solely by the host.
Eviction Policies Procedure: The housekeeper or property caretaker will notify the host of any violations, the host will then contact the guest directly to request immediate eviction. If this request is not complied with, the matter will be reported to the relevant authorities for further action.
10. Governing Law and Dispute Resolution
Jurisdiction: The legal jurisdiction governing the agreement is Kenyan Law.
Dispute Mechanisms: This contract will strictly apply litigation upon breach.
